The Declaration of Remembrance — Terms and Conditions

Honor and Remember, Inc., a 501(c)(3) nonprofit organization (“Honor and Remember,” “we,” “us,” “our”) operates The Declaration of Remembrance (the “Declaration”) located at thedeclarationofremembrance.com (the “Site”).

Acceptance of These Terms

By accessing the Site, signing or submitting the Declaration, creating an account, making a donation, or otherwise using our services (collectively, the “Services”), you agree to these Terms and Conditions (“Terms”) and our Privacy practices described herein. If you do not agree, do not use the Site or Services.

What is the Declaration of Remembrance?

The Declaration of Remembrance is a national, nonprofit‑led marketing and awareness platform created and operated by Honor and Remember to honor fallen service members, elevate awareness of Honor and Remember, and mobilize public support for remembrance. It is not a government website and does not collect official votes or petition signatures for any governmental body.

Donations and Use of Funds

All donations collected on or through the Site go directly to Honor and Remember. Funds may be used to advance Honor and Remember’s mission, which includes supporting remembrance programs, families of the fallen initiatives, public education, and operations, as well as promoting The Declaration of Remembrance. Unless we expressly say otherwise, donations are charitable contributions to a 501(c)(3) and may be tax‑deductible to the extent allowed by law. Consult your tax adviser. Unless required by law or our posted policy, donations are non‑refundable. If you believe a charge was made in error, contact us at [email protected] within 15 days.

If you elect a monthly gift, you authorize Honor and Remember to charge your selected payment method each month for the amount shown until you cancel. You may cancel at any time by contacting [email protected] or using any provided self‑service cancellation link at least 3 business days before the next charge. We will email a receipt for each successful charge. We do not store full card numbers on our servers; payment data is handled by our PCI‑compliant processor.

Checkbox/Agreement Language (for your checkout UI): “By checking this box, I authorize Honor and Remember, Inc. to charge my card monthly for the donation amount I selected. I understand this authorization remains in effect until I cancel by contacting Honor and Remember in writing or via the methods provided.”

User Accounts

You are responsible for keeping your login credentials confidential and for all activity under your account. Please notify us immediately of any unauthorized access to your account.

User Content and License

If you submit any comments, information, feedback. stories, remembrances, pictures, videos, testimonials or other materials (the “Materials”) to Honor and Remember or to the Site, such Materials are not confidential.  By providing any Materials to Honor and Remember or the Site, you warrant that you have all necessary rights to grant, for you and any other person that may have a right to the Materials, and hereby automatically grant to Honor and Remember a royalty-free, worldwide, perpetual, irrevocable, non-exclusive and fully sublicensable right (including any moral rights) and license to use, store, license, reproduce, modify, creative derivative work from, publish, publicly display, publicly perform, and distribute such Materials (in whole or in part) and to incorporate all or part of the Materials in other works, including for marketing and fundraising purposes, in any form, media, or technology. If you submit feedback or suggestions about the Site or our programs or services, we may use your feedback or suggestions without obligation to you.  Honor and Remember may use the Materials in any way without acknowledgment or compensation to you.  You accept all risks associated with providing Materials to us or the Site. You shall be solely responsible for your own Materials and the consequences of submitting, posting, or publishing them.

Acceptable Use

You may use the Site only for lawful purposes and in accordance with these Terms.  You agree not to misuse the Site or Services in any manner, including, but not limited to, by: posting unlawful, harassing, hateful, defamatory, obscene, indecent, abusive, offensive, inflammatory or objectionable content; posting any content that infringes on the intellectual property or proprietary rights of others; posting any content that violates any applicable laws or regulations; attempting to breach the security or disrupt the operations of the Site or Honor and Remember; scraping or mining the Site without our written permission; impersonating us or others; promoting any illegal activity or assisting any unlawful act; engaging in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site; using the Site or Services for commercial advertising. We may remove content or restrict access for violations.

Third‑Party Links

The Site may contain links to third‑party websites. Any such links for provided solely as a convenience to you.  Neither the inclusion of any links nor the reference to any party, products, services or other information constitutes or implies endorsement, sponsorship or recommendation by Honor and Remember.  Third-party websites have their own terms of use and privacy policies. We are not responsible for their content or practices.

Intellectual Property

The Honor and Remember name, logos, the Honor and Remember Flag, Declaration of Remembrance marks, the Site, and all Site content, graphics, materials and information, and all intellectual property rights therein, are owned by Honor and Remember or its licensors and are protected by law.

Disclaimers

WE PROVIDE THE SITE, ITS CONTENT AND SERVICES “AS IS” AND “AS AVAILABLE,” WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.  NEITHER HONOR AND REMEMBER NOR ANY PERSON ASSOCIATED WITH  HONOR AND REMEMBER MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE. WITHOUT LIMITING THE FOREGOING, NEITHER HONOR AND REMEMBER NOR ANYONE ASSOCIATED WITH HONOR AND REMEMBER REPRESENTS OR WARRANTS THAT THE SITE, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.  TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR PURPOSE, AND NON‑INFRINGEMENT.

Limitation of Liability

To the fullest extent permitted by law, in no event shall Honor and Remember, its officers, directors, employees or agents BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

Indemnification

You agree to defend, indemnify, and hold harmless Honor and Remember and our directors, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Site and Services, the Materials you submit, or your violation of these Terms.

Children’s Use

The Site and Services are intended for individuals 18 years and older. If we learn that a child under 18 submitted personal information, we will delete it.

Geographic Restrictions

Honor and Remember is based in the United States and the Site is controlled from the United States. We do not represent that the Site, its content or Services are appropriate or accessible outside of the United States. If you access this Site from outside of the United States, you do so on your own initiative and are responsible for compliance with local laws.

Changes to the Terms

We may update these Terms from time to time. The Effective Date at the top reflects the latest version. Continued use of the Site and Services after changes are posted constitutes acceptance of the revised Terms.

Governing Law; Dispute Resolution

These Terms and the Site, and any dispute or claim arising therefrom or related thereto shall be governed and construed in accordance with the laws of the Commonwealth of Virginia, without regard to any conflict of law provisions. Any suit, action or proceeding arising out of or related to these Terms or the Site or Services shall be brought exclusively in the state courts of the Commonwealth of Virginia located in Chesapeake, Virginia or the United States District Court for the Eastern District of Virginia, Norfolk Division, located in Norfolk, Virginia.  You irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these Terms or your use of the Site or Services and you waive any and all objections to the exercise of jurisdiction over you by such courts and venue in such courts.  You and we waive the right to a jury trial.

Waiver and Severability

No waiver by us of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Honor and Remember to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.  If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Honor and Remember regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
